What is TPD?
TPD stands for Tobacco Products Directive. Although designed to regulate the tobacco industry, the bill also deals with electronic cigarettes. You can find the e-cig specific regulations in Article 20 of the TPD.
As of May 2016, TPD Compliance came into effect where Manufacturers, retailers and vapers were bound to comply by the new regulations.
What is the purpose of TPD?
TPD exists to for a number of reasons including:
1. Protecting Children and Teens from Nicotine Products
2. Protecting consumers by creating enforceable standards for safety and the overall quality of all E-Liquids and vaping devices. This includes providing information to consumers so that they make informed choices.
3. Protecting consumers / customers by requiring manufacturers and retailer to provide useful information on the product or outer packaging, including increased labelling information.
How is a product TPD Compliant?
1. All e-liquids and vaping devices must notify and register with the Medicine and Healthcare Products Regulatory Agency (MHRA) before a product can be offered for sale in either the UK or European Union.
2. Product Restrictions Limited on E-Liquids and Vaping Devices:
1) Vaping Devices whether Disposable or Refillable must have a capacity of no more than 2ml
2) Each device containing nicotine is restricted to a 10ml bottle.
3) E-Liquids cannot contain specific ingredients such as colouring, caffeine and taurine including other ingredients voted upon by the member states of the European Union.
4) Emission Testing is required for all e-liquids / devices and must be certified by a laboratory.
3. Packaging and Labelling Requirements
1) Nicotine Warning Statement ‘This product contains nicotine which is a highly addictive substance’ must cover 30% of the front and back of the packaging and must also state the nicotine content.
2) Warning Pictograms must be present on the Box.
3) A safety warning leaflet must be included containing all instructions and warning of the product.
